Floodplain Development Permit (FDP)

  1. Floodplain Development Permit

    THE FILING FEES FOR A FLOODPLAIN DEVELOPEMT PERMIT IS $100 (non-refundable)

    Fill out the application completely and mail a check to Lawrence County Planning & Zoning, made payable to Lawrence County Treasurer to 90 Sherman Street, Deadwood, SD 57732 and please note it is for a Floodplain Development Permit. .

    Pay fees: Make checks payable to Lawrence County Treasurer’s Office (all returned checks have a $40 fee)

  2. ITEMS NEEDED FOR A FLOODPLAIN PERMIT:
    * Application
    * Plans drawn to scale showing the nature, location, dimensions and elevations of the area in question;
    * A map showing FEMA’s effective firm overlay on the proposed action (i.e. structure; culverts; etc)
    * Existing or proposed structures, fill, storage of materials, drainage facilities;
    * Description of flood-proofing methods (e.g., elevated on compacted fill; flood proofing using bulkheads, sealers’ elevated on poles or columns or concrete walls);
    * If development is a mobile home describe anchoring techniques;
    *A description of the extent to which any watercourse will be altered or relocated;
    *Attach all relevant engineering data and certificates by a Registered Professional Engineer. (If this includes an Elevation Certificate, then as-built elevations may be required after completion of the structure):
    and *A written summary of request.

    Substantial Improvement:
    * Requires a Detailed Improvement List
    * Requires a appraisal/assement Value

  5. This is the FEMA FIRM PANEL # which tells us where you are located within the Floodplain.
  6. Special Flood Hazard Designation (Zone): April 17, 2012*
    All building permits requested that have any part of the property in a floodplain may be required to also obtain a floodplain development permit (FPD).
  7. 50% Substantial Improvement
    This section will only be filled out if you are requesting a determination on Substantial Improvement (>50%/<50%)
    You will need to provide a Detailed Cost List (or attached itemized bills/bids)
    The formula used to figure this out will be using Fair Market Value (determined / Equalization records or current appraisal by a SD licensed Appraiser) 50% of that value - the Detailed Costs if Improvements = the Remaining value left 50% Improvement Costs
  8. This will be your land value only according to Lawrence County Equalization Records
  9. This will be your structure value according to Lawrence County Equalization Records
  10. Submit photos; letters from Engineers; Surveyors; and all HEC RAS Analysis Information
  11. NON-CONVERSION AGREEMENT
    Accessory structures with the floor located below the flood protection level are designed to be flooded and should not be converted to uses that are incompatible with the flood hazard. Conversion to finished living space, blockage of flood vents, or installation of unprotected equipment (appliances, heating/cooling equipment, plumbing fixtures, etc) may violate the conditions of the floodplain development permit or the floodplain variance.
  12. ACKNOWLEDGEMENT*
    The OWNER, CONTRACTOR, OR AUTHORIZED AGENT, CERTIFIES: That he/she has read a copy of the Lawrence County Floodplain Ordinance and will proceed with development accordingly. That he/she will submit a post-construction Elevation Certificate on required structures. That he/she understands the limitations on future construction and use of an enclosed area and has read the Non-Conversion agreement above. That he/she certifies that the information submitted is true and correct to the best of their knowledge. That he/she authorizes the Lawrence County Planning Department staff and designees to enter on to and inspect the above-described property. That if the signatory below is someone other than the property owner, the signatory represents and warrants they have full authority to sign this permit on behalf of the property owner and to bind the owner to all terms and conditions herein
  13. Electronic Signature Agreement
